1. Introduction
Welcome to Dubai Gold Gems, a premier online auction marketplace for precious metals, gemstones, and jewelry. These Seller’s Terms and Conditions govern your participation as a seller on our platform. By registering and listing items, you agree to comply with these terms, UAE laws, and international regulations.
2. Seller Eligibility & Registration
- Sellers must be at least 21 years old and legally authorized to trade in precious metals and gemstones.
- Businesses must provide valid trade licenses (UAE or international), social media reviews, website links (if available), and tax identification numbers (if applicable).
- Dubai Gold Gems reserves the right to verify seller identities and reject suspicious accounts without explanation.
3. Prohibited Items & Compliance
Sellers must not list:
- Conflict diamonds (must comply with the Kimberley Process Certification Scheme).
- Counterfeit or synthetic items misrepresented as natural.
- Stolen or illegally sourced gems/metals (proof of provenance required upon request).
- Items violating UAE export/import laws, international sanctions, AML/CFT regulations, or UN laws (e.g., child labor, social abuse, worker exploitation).
- Sellers are responsible for authentic sourcing of the gems and jewelry. They are responsible to adopt every possible measure to obey: international sanctions, AML/CFT regulations, or UN laws (e.g., child labor, social abuse, worker exploitation).
4. Listing Requirements
- Accurate descriptions: Include carat weight, color, clarity, dimensions, certifications, and flaws.
- High-quality images/videos: Minimum 3 images, including 1 video showing hallmarks/certificates, Showing no reference to private contact or websites
- Disclosure of treatments: e.g., heat treatment, oiling, fracture filling etc.
- Certified gemstones: Preferred certifications from GIA, IGI, AGS, or other reputable labs.
- Metal Purity: Items must have hallmarks (e.g., Dubai Good Delivery standards).
5. Auction Rules & Fees
- Listing Fee: Free for a limited time
- Shop listing fee; free for limited time.
- Success Fee: 7% of the final sale price.
- Reserve Price: Optional but must be reasonable and realistic.
- Bidding Increments: Set by Dubai Gold Gems.
- Payment: Buyers must pay within 48 hours; sellers must ship within 3 business days after payment clearance.
- Escrow: Trade amount will be held in ESCROW for 1 week, after that, amount will be released to the seller if no damage or fraud is reported by the buyer. The buyer can still return the item up to 14 days, but after one week the buyer will communicate with the seller for any refund, Dubaigoldgems.ae has no control over the payment refund after 7 days, day 1 is the delivery day.
6. Fraud Prevention & Disputes
- Escrow Protection: Payments held until buyer confirms receipt and satisfaction.
- Misrepresentation Claims: Buyers may return items within 14 days if materially misdescribed. The buyer needs to inform the seller/ start the returning process within 7 days of the receipt of the item, day 1 is the day of delivery. Once the return process has been started the customer service will know and may refund the payment with seller consent.
- Fraudulent Activity: Sellers engaging in fraud will be banned, reported to UAE authorities, and liable for legal action.
7. Shipping & Insurance
- Shipping: Use tracked, insured carriers (e.g., DHL, FedEx, Emirates Post Registered).
- Seller Responsibility:
- Safely deliver the original, authentic item to the buyer.
- Sellers must submit to customer service and keep with themselves 2-3 pictures of the exposed item alongside the shipping receipt at the courier office, before shipping. They can do it themselves or by courier person with special request by the seller.
- Insurance of shipments for the item’s exact value.
- Buyer Verification of item: To ensure transparency and protect themselves against fraudulent activity, all buyers are required to submit a short video to customer service documenting the unsealing of their purchased item. This video serves as proof of the item’s condition upon receipt and helps resolve any disputes that may arise.
- Customs/Duties: Sellers clearly state responsibility in item listings.
- Loss/Damage: Seller liable until delivery confirmation by buyer.
8. Refunds & Returns
- Buyer’s Remorse (Change of Mind): No returns unless explicitly allowed by the seller.
- Misrepresented Items: Full refund upon return in original condition.
- Non-Payment: Item relisted after 48 hours; buyer may face penalties.
9. Data Privacy & Security
- Seller data is protected under UAE Data Protection Laws.
- Dubai Gold Gems may share seller details with law enforcement if required.
10. Termination & Suspension
- Dubai Gold Gems may suspend or terminate accounts for violations without refund.
- Sellers may terminate accounts with 30 days’ notice, pending resolution of active transactions.
11. Governing Law & Jurisdiction
- Governed by UAE law.
- Disputes resolved in Dubai courts.
